Welcome to Sold On Scene. These Terms & Conditions govern your use of the Sold On Scene website and your purchase of services, products, programs, and other offerings provided by Sold On Scene.
By accessing this website, submitting an inquiry, purchasing a service, enrolling in a program, or otherwise engaging Sold On Scene, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and any applicable service-specific policies presented at the time of purchase.
If you do not agree to these terms, please do not purchase or use Sold On Scene services.
1. ABOUT SOLD ON SCENE
Sold On Scene is a real estate marketing company providing marketing strategy, content development, personal branding support, listing marketing, educational resources, and related creative and marketing services primarily for real estate professionals.
The specific scope, deliverables, timelines, and requirements of a service may vary based on the offer purchased. The description displayed on the applicable service page, checkout page, proposal, invoice, or written agreement becomes part of the agreement between Sold On Scene and the client.
2. SERVICES & SCOPE OF WORK
Clients are responsible for reviewing the description and included deliverables of a service before purchasing.
Only deliverables expressly included in the purchased service are included in the purchase price. Additional strategy, content, revisions, filming, travel, design, editing, rush delivery, additional properties, or other work outside the stated scope may require an additional fee.
Sold On Scene may reasonably adjust internal processes, workflows, platforms, or methods used to complete a service provided that the core purchased deliverables are not materially reduced.
3. CLIENT RESPONSIBILITIES
To provide services effectively and on schedule, clients may be required to provide information, property details, brand materials, account access, approvals, availability, filming or property access, and other requested materials.
The client is responsible for ensuring that information provided to Sold On Scene is accurate and that the client has permission to provide and use any materials, photographs, video, logos, property information, testimonials, music, trademarks, or other content supplied to Sold On Scene.
Delays in providing required information, access, approvals, or materials may result in corresponding delays to the project or scheduled launch.
4. PAYMENTS
All prices are displayed in U.S. dollars unless otherwise stated.
Payment is required according to the payment terms shown at checkout, on an invoice, proposal, service page, or written agreement.
Some Sold On Scene services may offer payment plans. When a payment plan is selected, the client authorizes the payment method provided at checkout to be charged according to the payment schedule displayed and accepted at the time of purchase.
Failure to complete a scheduled payment may result in paused services, withheld deliverables, cancellation of future work, or collection of an outstanding balance as permitted by law.
5. VISIBILITY PARTNERSHIP
The Visibility Partnership is a three-month marketing engagement unless a different term is expressly stated in writing.
The current three-month investment is $2,991, structured as an initial payment of $997 at checkout, followed by two additional payments of $997, charged approximately one month and two months after purchase.
By purchasing the Visibility Partnership, the client understands that the agreement represents a commitment to the full three-month engagement and not three unrelated month-to-month purchases.
Cancellation, missed participation, delayed responses, or a decision by the client not to utilize available services during part of the engagement does not automatically eliminate payment obligations for the committed term, except where otherwise required by law or expressly agreed to by Sold On Scene in writing.
6. CONTENT DAYS & PRODUCTION SERVICES
Content Days and other production-based services are scheduled subject to Sold On Scene’s availability.
Clients are responsible for arriving or being available at the agreed location and time and for being prepared with any clothing, props, property access, permissions, or other materials discussed during planning.
Production time lost because of client lateness, lack of access, missing materials, or other client-caused delays may reduce the amount of content that can be captured and does not automatically entitle the client to additional production time.
Unless otherwise stated in the purchased service, additional filming time, locations, travel, reshoots, or content outside the agreed scope may require an additional fee.
7. LISTING LAUNCH SERVICES
Listing Launch services are created for a specific property and are dependent upon the client providing accurate property information, expected listing dates, property access, necessary permissions, and requested materials in a timely manner.
Requested production or launch dates are not guaranteed until confirmed by Sold On Scene.
Changes to a listing date do not automatically guarantee that Sold On Scene can accommodate a corresponding change to the marketing or production schedule.
If a property is delayed, withdrawn, sold, placed under contract, or otherwise changes status after work has begun, fees already paid are not automatically refundable. Sold On Scene may, at its discretion, allow unused portions of the service to be rescheduled or credited.
8. SCHEDULING & RESCHEDULING
Appointments, production sessions, strategy calls, and other scheduled services are subject to availability.
Clients should provide at least 48 hours’ notice when requesting to reschedule a scheduled service.
Requests made with less than 48 hours’ notice may be subject to a rescheduling fee or may result in forfeiture of the scheduled session, except in emergencies or circumstances otherwise approved by Sold On Scene.
Sold On Scene may reschedule services when reasonably necessary due to illness, emergency, unsafe conditions, weather, property access issues, or other circumstances outside its reasonable control.
9. CANCELLATIONS & REFUNDS
Because Sold On Scene reserves capacity and may begin strategy, planning, research, preparation, or other work shortly after purchase, payments are generally non-refundable once work has begun.
Unless otherwise stated in writing, completed work, delivered digital products, strategy services, deposits, and services already rendered are non-refundable.
If Sold On Scene is unable to provide a purchased service and cannot reasonably reschedule or provide an agreed alternative, Sold On Scene may issue an appropriate refund or credit for the portion of the service that was not provided.
Nothing in these Terms is intended to limit any refund or cancellation rights that cannot legally be waived.
10. REVISIONS & APPROVALS
The number of revisions included with a service, if any, will be stated in the applicable service description or agreement.
Revision requests must remain within the original scope of the project. Requests that substantially change the original direction, require new filming, introduce new deliverables, or otherwise expand the scope may require an additional fee.
Clients are responsible for reviewing deliverables carefully before approving or publishing them, including checking names, dates, property information, pricing, contact information, brokerage information, and other factual details.
11. CONTENT OWNERSHIP & USAGE
Upon receipt of full payment, the client may use final deliverables created specifically for the client for the client’s own business and marketing purposes, subject to any third-party licensing restrictions applicable to elements incorporated into the work.
Sold On Scene retains ownership of its pre-existing materials, systems, frameworks, templates, processes, methodologies, educational materials, and other intellectual property, including the Sold On Scene brand and proprietary frameworks.
Unless otherwise agreed in writing, purchasing a service does not transfer ownership of Sold On Scene’s underlying templates, systems, processes, raw working files, or proprietary materials.
12. PORTFOLIO & PROMOTIONAL USE
Unless otherwise agreed in writing, the client grants Sold On Scene permission to display completed work created for the client for portfolio, website, social media, case study, educational, and promotional purposes.
Sold On Scene will make reasonable efforts to respect legitimate confidentiality or timing concerns communicated by the client, including requests not to publish listing-related materials before a property is publicly marketed.
Clients who require their work to remain confidential should notify Sold On Scene in writing before services begin.
13. REAL ESTATE INFORMATION & COMPLIANCE
Sold On Scene provides marketing and creative services and does not act as the client’s real estate broker, supervising broker, attorney, compliance officer, or other licensed advisor.
The client remains responsible for ensuring that all advertising, property information, claims, disclosures, brokerage requirements, MLS requirements, fair housing obligations, and other marketing materials comply with applicable laws, regulations, professional rules, brokerage policies, and platform requirements.
Sold On Scene may request changes or decline to create or publish content that it reasonably believes may be misleading, discriminatory, unlawful, or otherwise inappropriate.
14. MARKETING RESULTS
Sold On Scene does not guarantee any specific number of views, followers, leads, inquiries, clients, transactions, sales, listings, commissions, engagement, revenue, or other business result.
Marketing performance depends on numerous factors outside Sold On Scene’s control, including the client’s market, audience, consistency, offer, reputation, pricing, participation, sales process, platform algorithms, and broader market conditions.
Any examples, testimonials, case studies, projections, or previous client results are illustrative and are not guarantees of future performance.
15. THIRD-PARTY PLATFORMS
Sold On Scene may provide services involving third-party platforms such as social media networks, website providers, scheduling platforms, email services, advertising platforms, or other software.
Sold On Scene does not control these platforms and is not responsible for outages, account restrictions, algorithm changes, policy changes, lost reach, removed content, suspended accounts, or other actions taken by a third-party platform.
16. INTELLECTUAL PROPERTY
Sold On Scene’s name, branding, original educational materials, strategies, frameworks, templates, processes, course materials, and other proprietary materials may not be copied, reproduced, resold, redistributed, republished, or presented as the client’s own products or intellectual property without prior written permission.
Client-specific final marketing deliverables may be used by the client as permitted under Section 11.
17. TERMINATION OF SERVICES
Sold On Scene reserves the right to suspend or terminate services for material nonpayment, abusive or threatening behavior, unlawful requests, repeated failure to provide materials necessary to perform the service, violation of these Terms, or other material breach of the parties’ agreement. When services are terminated, amounts owed for work already performed and any enforceable outstanding commitments remain due.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Sold On Scene will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of its services, including lost profits, lost business opportunities, lost leads, or changes in social media or marketing performance. To the fullest extent permitted by law, Sold On Scene’s aggregate liability arising from a particular purchased service will not exceed the amount actually paid by the client to Sold On Scene for the service giving rise to the claim.
19. CHANGES TO THESE TERMS
Sold On Scene may update these Terms & Conditions from time to time. Updated terms will be posted on this website with a revised “Last Updated” date. Changes will apply prospectively and will not retroactively alter material payment or service obligations already agreed to unless the parties agree otherwise or applicable law requires it.
20. GOVERNING LAW
These Terms & Conditions are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute will be handled in accordance with applicable law and any additional dispute-resolution terms contained in a separately executed agreement between Sold On Scene and the client.
